Introduction

Whisker Architecture provides architectural services across Victoria, Australia.

By booking a service through our website, you enter into a Client Architect Agreement (Refer Below) with Whisker Architecture. This agreement governs the services you have selected and will be provided to you as part of your booking confirmation.

This page provides general information about how our services operate. In the event of any inconsistency, the Client Architect Agreement takes precedence.

Service Eligibility

Services are available within Victoria, Australia.

General Exclusions

Our services do not include legal, financial, or building condition advice. Any site visits are undertaken solely to inform architectural design.

Client Architect Agreement

PRE-DESIGN SERVICES ONLY

 

1. Parties

2. Agreement Formation

By proceeding with a booking and confirming acceptance at checkout, the Client enters into this Client Architect Agreement with Whisker Architecture.This Agreement is formed on the date of booking and confirmed via written email issued by Whisker Architecture.

3. Services

This Agreement applies to the following pre-design services offered by Whisker Architecture and booked via www.whiskerarchitecture.com:

  • Architect Site Consult

  • Prepurchase Masterplan Report

  • Home Masterplan Report

  • Developer Masterplan Report

The specific service selected by the Client forms the Scope of Services under this Agreement.

4. Scope of Services

Services under this Agreement provide feasibility, strategic advice, and concept-level architectural input appropriate to the selected service.Detailed descriptions of each service are provided on the Whisker Architecture website at the time of booking. These descriptions are indicative and do not form an exhaustive or fixed list of deliverables.

Unless otherwise agreed in writing, services do not include:

  • detailed design or construction documentation

  • consultant coordination

  • statutory approvals

  • engineering, certification, or specialist reports

  • building inspection services

Any services not expressly included are excluded and may be provided as an additional service.

5. Nature of Advice

All services are preliminary and advisory in nature.The Client acknowledges that:

  • advice is based on available information at the time

  • cost estimates are indicative only

  • planning and building approvals are not guaranteed

  • further investigation, consultant input, and documentation will be required before construction

The Client is responsible for decisions made based on this advice.

6. Fees and Payment

Fees are fixed for each service and are payable in full at the time of booking. Pre-design services are mobilisation services, covering:

  • allocation of resources

  • commencement of work

  • intellectual property creation

7. Timeframes

Indicative timeframes commence from completion of the On-site Briefing Session or initial consultation, not from the date of booking.

Timeframes are estimates only and depend on:

  • client availability

  • timely provision of information

  • alignment of schedules

Whisker Architecture will use reasonable endeavours to meet these timeframes and will notify the Client as soon as practicable if delays are anticipated.

Indicative timeframes from the On-site Briefing Session:

  • Prepurchase Report: ~1–2 weeks

  • Home Masterplan Report: ~2–4 weeks

  • Developer Masterplan Report: ~3–5 weeks

8. Client Responsibilities

The Client agrees to:

  • provide accurate and complete information

  • attend scheduled meetings

  • involve all relevant decision-makers

  • respond within a reasonable timeframe

  • Whisker Architecture is entitled to rely on information provided by the Client and is not responsible for inaccuracies in that information.

9. Variations

Each service includes a defined scope appropriate to its purpose.

Additional services, iterations, or expanded scope:

  • are not included

  • may be provided as a variation or separate agreement

Additional services may be required, including:

Existing Conditions Site Measure

If no reliable drawings are available:

  • $180/hr incl. GST + travel

  • typically ~$1,500

  • confirmed prior to proceeding

Travel

Projects more than 2 hours from Williamstown:

  • $250/hr incl. GST

  • confirmed in advance

10. Intellectual Property

Whisker Architecture retains copyright in all drawings, documents, and concepts.

The Client is granted a non-exclusive, royalty-free licence to use the material for the purposes of their project.

The Client may engage other consultants or designers to progress the project based on the information provided.

Whisker Architecture is not responsible for:

  • any use, modification, or interpretation of the documents by others

  • outcomes resulting from work undertaken by third parties

11. Communication

The Architect will communicate via email and scheduled meetings and will provide deliverables in digital format.

12. Cancellation and Refunds

Bookings may be cancelled within 48 hours for a full refund.

After this time, work may have commenced and refunds will be provided in accordance with Australian Consumer Law.

13. Withdrawal

Whisker Architecture may withdraw from providing services where required to comply with professional, ethical, or regulatory obligations. Written reasons will be provided where applicable.

14. Liability

To the extent permitted by law, the Architect’s liability is limited to:

  • the re-supply of the services; or

  • the reasonable cost of having the services supplied again

Whisker Architecture is not liable for:

  • indirect or consequential lossreliance on preliminary advice

  • outcomes arising from third-party involvement

15. Complaints and Professional Standards

Whisker Architecture is registered with the Architects Registration Board of Victoria (ARBV).

Clients are encouraged to contact Whisker Architecture directly in the first instance so concerns can be resolved promptly.

If a matter cannot be resolved, Clients may contact the ARBV regarding professional conduct.

16. Insurance

The Architect maintains professional indemnity insurance appropriate to the services provided.

17. Governing Law

This Agreement is governed by the laws of Victoria, Australia.
